Limitation of Liability Disclaimer
These Disclaimers form an integral and enforceable part of the Terms and Conditions (T&Cs) of the Platform and should be read in conjunction with our Terms and Conditions, other Policies, Guide Policies.
1. Platform Role and Limitation of Liability Disclaimer
1.1 Vesselglobe operates solely as a neutral online Platform that facilitates connections and communications between users, including but not limited to shipowners, crew, and other maritime service providers. Vesselglobe is not a party to, and assumes no responsibility for any contracts, agreements, or transactions entered into between the Users of the Platform, including but not limited to vessel sales, charters or employment arrangements. Users acknowledge and agree that Vesselglobe does not act as an agent, broker, or representative of any party in such transactions. Vesselglobe does not inspect or verify the condition and the quality of any vessels or services listed on the platform, nor does it assess or guarantee the competence, qualifications, or licenses of users, other than conducting a limited initial verification process applicable to shipowners, as described in the platform’s policies. All users are solely responsible for conducting their own due diligence before entering into any agreement or transaction with another user, and Vesselglobe expressly disclaims any and all liability arising from or related to such interactions.
1.2 To the fullest extent permitted by the applicable law, Vesselglobe shall only be liable for direct losses arising from the use of the Platform. Vesselglobe’s total liability shall not exceed the amount of an annual subscription paid by the User.
1.3 Vesselglobe shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of business, loss of data, or business interruption.
2. Accuracy of Information and Third-Party Content Disclaimer
2.1 Vesselglobe disclaims all liability for the accuracy, completeness, or legality of any information submitted by users, including but not limited to vessel specifications and job postings.
2.2 Vesselglobe’s review is limited to basic checks for readability and spam, and does not extend to verification or endorsement of the substantive content. Users expressly assume all risks associated with reliance on such information, and shipowners shall remain solely responsible for the accuracy and legality of their submissions.
2.3 The Platform may contain content provided by third parties, including, but not limited to, external data sources, (such as vessel tracking systems), and integrated third-party services. Vesselglobe does not control, verify, or endorse such content and expressly disclaims any and all liability arising from or related to its accuracy, completeness, or reliability.
3. Service Interruptions and Warranties Disclaimer
Vesselglobe does not warrant or guarantee that access to the platform will be uninterrupted, timely, or free from errors. Users acknowledge that the platform may be subject to limitations, delays, outages, bugs, or other technical issues, including potential loss of data or functionality. Vesselglobe shall not be held liable for any direct, indirect, incidental, consequential, or special damages, losses, or expenses arising from or related to any interruption, suspension, malfunction, delay, or inability to access or use the platform, whether caused by system maintenance, technical failures, third-party services, or otherwise. While Vesselglobe will make commercially reasonable efforts to maintain the availability and reliability of its services, no guarantees or warranties, express or implied, are made in this regard.
4. Force Majeure Disclaimer
Vesselglobe shall not be held liable for any failure or delay in the performance of any of its obligations, where such failure or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, acts of war, terrorism, civil unrest, labor strikes or other industrial disturbances, government restrictions or actions, embargoes, power or utility outages, or failures of internet or telecommunications networks or services.
In any such event, Vesselglobe shall be released from all liability and responsibility for such failure or delay, and shall not be required to provide any refund, reschedule any service, or offer any compensation or remedy whatsoever, to the maximum extent permitted by applicable law.
5. Assumption of Risk Disclaimer
By accessing and using the Vesselglobe platform, users acknowledge and agree that they assume all risks arising from their use of the platform and any interactions, communications, or transactions with other users. Vesselglobe shall not be responsible or liable for any losses, damages, or liabilities incurred as a result of such use or dealings.
6. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
7. Disclaimers Update:
We may update these Disclaimers periodically to reflect changes in legal requirements. Any updates will be posted on this platform, and the user will be notified via email of significant changes
